Mitigation banking is a relatively new industry and the permitting of banks varies by state. The federal framework is uniform for all states, while the state framework may vary. Some states, while participating in the process defer to the federal regulations while other states are more active and will require a separate state issued permit. It is also important to understand the regulatory framework for the impacts (which are also dictated by the regulations) and how these impacts are then translated into the sale of credits.
